Secondly, since the Boltons did maintenance on the road last they have the greatest claim on levying a toll though they can and probably do delegate that to their vassals. Therefore I'm inclined to believe that the Whitehills are allowed to levy a tax and it's only a matter of whether or not it's excessive and used as a punitive measure in their feud against the Forresters.
I think you're both blowing this out of proportion. The North is gigantic, including the forests, and no amount of poaching by the small population that are even capable of hunting is going to hurt the "food supply" of Stark or the North as a whole. In fact one might argue that poaching actually increases the food supply since a lot of deer die during the winter of natural causes.

Make it clear to the court that by torturing the sabotager to death the Forresters denied the court the ability to assess his testimony, thus both foiling the court's ability to examine potentially valuable evidence as well as leaving the foresters with no evidence to their claims, forcing you to rule against them.
Don't torture critical witnesses to death so that they don't get to testify before court yo.

Specifically noble men. Not peasants whose crops have been rotting due to blight. For all we know the procedure for peasants who can't toil their farms due to not having the labor for it is starvation. Wouldn't be the first.I mean, the update started with men literally drawing chits to see who has to go to the Wall.
We can assume from that alone that they have the social rules and procedures to ensure that someone like the poachers family can carry on without their head of household.

Yes, House Stark and any noble house in this era, particularly in the North, is under hunting. I thought that was obvious in my post. The nobles use hunting as a hobby when they get bored, not as a means to acquire food.The North is gigantic yes, but deer need to walk to get places (or be walked after being killed) so its less the total over all, and more the deer numbers near Wintertown. and it is a issue with poaching that any given act of poaching is more or less OK, but if it is let to happen then it will happen as poaching is close to free money in this time. unless you think that the Stark's are under hunting of course then it really is no issue.

However, the levy must be set at a reasonable level that is comparable to other road tolls levied in the North. House Whitehill is responsible for the actions of its armsmen and must provide recompense to House Forrester. The recompense shall be set at half the cost of repairing the dam. Any further actions against the dam or similar infrastructure by House Whitehill or servants of House Whitehill will face significantly more harsh punishments as decided on by House Stark.
