Well smither's really, burns is all he has for family, and he will become a constant thorn if abe kills burns(lets face it, for as much of the shit burns put on waylons jr, burns is all he has left for a father figure)
let burns die in jail in old age and let smithers slowly come to the realization that burns was an ass(with the help with the spirit of waylon sr) And let him move on from a chapter of hia life that was defined by burns and let him be thr one to decide his own destiny(one free from burn's influence)

Keep in mind once we really checked what burns owned, later we could have the possibility to throw the ball to the higher tribunalss for treason crimes which would probably put Burns on the way to the chair.
