For once it actually makes sense. They don't believe that the new seal is what it really is said to be, or that they believe they're children will get the old seal for this action.
Don't know why our Uncle hasn't used the caged bird seal on them yet. I know he doesn't want to do it, but he could easily do that before going lethal. Hell, this exact situation is probably why that function originally existed. The hyuuga have trouble going nonlethal when they really get going, so the seal gives a method to subdue without resorting to kinslaying.
@Magoose there isn't any special reason our Uncle couldn't use the seal to stop the branch members that are rebelling if his hand is forced right?
And related to this event and my plan to deal with it, how is Kakashi's sharingan legally viewed by the Uchiha? I've seen fanon where they want to steal it back, fanon where they laugh at his suffering since he also has a PTSD eye now, and fanon where they believe that it's a sacred thing for a Uchiha to gift another their eyes (even if it's unusual for it to be a non-clan member).

Hiashi is trying to hold the moral high ground at the moment, and if he were to use it, he'd be no better then all the heads who came before him.
So he is using his own power to stop the clan from killing him and his family, and if he can take most of them alive, he can trie them for treason, and basically win the moral and generational victory, meaning the caged bird might not have to be used ever again.
Layman's terms: He wins through his own power, the seal is no longer needed because everyone who cares about it is on his side, imprisoned, or dead.
The Uchiha are actually very fine with the whole thing, considering that he now has deprived Obito of a functioning eye.
as for any fanon related stuff... Well... I mean I would go into fanon stuff, but not now.
Let me just say that there are a few who respect Obito's dying wish, and others who do not and want to remove the eye... it just depends on the person inthe Uchiha clan.
As long as Fuguka says it's fine, no one can do a damn thing about it.

That's why there are kids... instead of... well you know... Shiro and Itachi planning to kill everyone in a blood rage.

ANBU needs help coordinating in less than five minutes, having someone with intel not distracted by kids helps.
