The Mandalorian

Yeah… that is only tangentially related to the thread. Might be better in a General Disney Company thread if we have one.

i mean it's pretty relevant to the future of the show - if she wins, Cara Dune reappearing in the next season to serve Djarin legal papers will be the exact moment this becomes the greatest TV show of all time

I may be misremembering, but I don't think she can win, seeing as how private companies are not required to respect your "freeze peach" and political ideology is not a protected class.

This is just right wing signaling.

On that note, what will 'being recast' even do for her? It's not like they have Cara Dune played by another actress, she's simply not in the story anymore just like other characters like the Bill Burr one. Does she intend to legally force them to write her as a main character in Season 4?

Can you even force yourself to be legally written into a show?

You cannot for a variety of reasons. What she can do is get monetary compensation for the career damages that she insists Disney inflicted on her. For example she would have been the lead of a miniseries (at least) in the Mandalorian universe. That's a pretty substantial payday to start with. If she did a good (enough) job it could help her career for decades.

For example how few cast members from the Mandalorian have been held up as examples of bad acting? And while Pedro Pascal wasn't exactly viewed poorly before the Mandalorian he has more fans and a better reputation now than he did before doing the show. That makes any future paycheck he gets bigger.

Total up a good "guesstimate" of the money she isn't making because of Disney and that's what she'd be arguing for as what she should get.

(Note I don't think Gina Carano has a chance of winning this against the House of Mouse but that's what she could get out of it.)

The more ironic is that her claim that Disney turned a blind eye to Pedro Pascal's denigrating tweets against Republicans is bollocks: Pedro posted a tweet comparing the MAGAists with Nazis and Confederates as the losers of History, that led to an uproar among the right wing public, Disney took disciplinary measures against Pedro Pascal who deleted the tweet and apologized.
Gina Carano posted tweets with right-wing opinions and conspiracy theories about the presidential elections, that led to an uproar among the center and left wing public, Disney took disciplinary measures against her whom instead of deleting her tweets like Pedro Pascal did, bitched and whined about the evil leftists trampling on her free speech, increasing the shitstorm tenfold. That's why she was fired.

If I'm remembering my contracts correctly, in theory she could sue for specific performance, for the court to compel Disney to perform their part of the contract should it be found to breached and Disney to be liable. But A. There's no way that a court would rule in her favor. and B. The remedy of specific performance is looked down on by courts because it places a large burden and is usually only used where compensatory damages wouldn't the best or more just remedy. If she won somehow she'd just get whatever damages the court estimated she'd be entitled for from the lost role.

Absolutely hysterical if they think that's going to happen, like holy shit apparently she's literally demanding they legally reinstate her into the show - my dude how do you think that's going to go?

I would hope that if, in some insane string of improbabilities, she won and Disney was somehow forced to re-hire her...only to immediately have a fucking rock fall on Cara's head and kill her before she got a single line.

"Oh damn, Cara's dead?"
"Shit...anyway back to what I was saying..."
