Yeah who wants to see heroes fight monsters. I for one love watching Captain America being led away in cuffs a broken man. That's what comics are about.
It's kind of a cop out when I'm promised a fight between two heroes divided by personal and ideological differences, and suddenly a third antagonist comes out of nowhere, so they resolve their differences and team up to beat the new foe. And this is not just a criticism of BvS, but of every time it happens in comics or in manga/anime. Say what you will about Marvel superhero fight crossovers, and God knows there is a lot to say about them*, but they mostly stick to the premise till the end.

*Comic books Civil War was just a mess, and Avengers vs. X-Men made everyone into assholes

Well comic books are a lot like Pro-Wrestling. Short of a heel turn Face vs Face feuds are really hard to maintain since you ideally want to have fans rooting for both sides which is hard when the fight. Having a bad guy show up is a good way to avoid splitting loyalties.

Pro-Wrestling is crap anyway, so taking superheroes away from that's a good thing.
 
Honestly, I fully expect Civil War to end with a compromise where the Superheroes do get regulated, but the guy running it is someone Cap can trust and is willing to mostly stay hands off with the Avengers, leaving Cap mostly satisfied. Coulson perhaps. Maybe Fury or Hill, though I'm not sure Cap really trusts either of those, and given both ended up following Rogers lead in Winter Soldier, I'm not really sure that'd work.
 
The main issue with Tony's side is that leaving oversight to the government would make sense, if Hydra wasn't always an issue. Also we know that when pushed they might make a decision that could kill millions. We've seen how much governments themselves make bad decisions as much as the heroes. Either way having a big brawl over it is the last thing they need to do.

Honestly I think there's a really good chance that they might just straight up bite the bullet and kill Cap, Steve Rogers Cap I mean, and have Bucky pick up his mantle. I mean there's been some light foreshadowing to that effect in the previous movies: in both First Avenger and Winter Soldier there's shots of Bucky striking a pose with the Captain America shield. But that could just be a wink-nod reference and them leaving their options open.

It's what happens in the comics after all, Cap gets assassinated and Bucky has to carry on in his stead (I've read that run of the Winter Soldier, it was pretty great don't judge me >>). I'm not sure how I'd feel about it or even if they'd have the stones to go through with it, but I think it's something I could really get behind if they sold it well.

Obviously in the comics Cap comes back. But still.

Dunno.
