First, Cero Triste does indeed work just fine in a spellcard duel - it doesn't need to hit to take effect, and the potency of the phantom images isn't tied to the amount of power behind the blast, so it still works while going non-lethal.
And second, while Nemo herself might not be invested in keeping the local social order running, keep in mind that many of the locals inevitably are.

If they take up a attuning slot it would almost appear like Aizen didn't want the Espada to take advantage of the magical artifact making tailor in Las Noches much like he doesn't seem to have wanted them to take advantage of their new training based growth potential.Funny as that is, a Caja Negacion need to be dropped into a hollow hole to work (so it wouldn't work on Kenpachi), and the cube vanishes whilst it's active anyway.

It's just sitting around for a last-minute save when Nemo uses her superior attunement capacity to trap Kenpachi in the stolen pokeball just long enough to Descorrer to as far away in Hueco Mundo as possible, throw the Caja Negacion into the black ocean at the end of the world, and then Descorrer back before he breaks out.
Kenpachi then starves to death before he finds any food or Hollows to eat, thus technically making Nemo the new Kenpachi as she killed him.
(On finding that Nemo killed a Captain, Aizen sends her on a suicide mission for the crime of stealing her Espada's Caja Negacion)
