Hmm. Two points:

First, Cero Triste does indeed work just fine in a spellcard duel - it doesn't need to hit to take effect, and the potency of the phantom images isn't tied to the amount of power behind the blast, so it still works while going non-lethal.

And second, while Nemo herself might not be invested in keeping the local social order running, keep in mind that many of the locals inevitably are.

She's a hermit. She's used to people fighting to kill her; Her immortality relies on her ability to fight off whoever the afterlife sends to collect her overdue soul.

Plus, she makes a point of robbing people on Christmas while dressed up as Santa (Yes this is something she does in canon).

How suspicious that Aizen would give them to the Espada then. They were already worthless for disciplining Fraccion since any Espada could discipline basically any Fraccion themselves, but they don't even have use against Shinigami? If they take up a attuning slot it would almost appear like Aizen didn't want the Espada to take advantage of the magical artifact making tailor in Las Noches much like he doesn't seem to have wanted them to take advantage of their new training based growth potential.

The only people who have any use for the things really are the Exequias', they're perfect for law enforcement.

I doubt Aizen knew, cared, or even thought of the magical artifact making tailor or attunement at all when he was tossing those things out.

I'm betting even res nemo would still fight by the rules of the spellcard duel because while her releaseis cold and callous, i's also logical, and probably won't be stupid and piss off yukari as she still needs something from her.

It's just sitting around for a last-minute save when Nemo uses her superior attunement capacity to trap Kenpachi in the stolen pokeball just long enough to Descorrer to as far away in Hueco Mundo as possible, throw the Caja Negacion into the black ocean at the end of the world, and then Descorrer back before he breaks out.

Kenpachi then starves to death before he finds any food or Hollows to eat, thus technically making Nemo the new Kenpachi as she killed him.

(On finding that Nemo killed a Captain, Aizen sends her on a suicide mission for the crime of stealing her Espada's Caja Negacion)

It does amuse me that Zaraki Kenpachi...technically isn't actually the Kenpachi. Really he should just be called Zaraki.

You become Kenpachi by killing the previous Kenpachi...except the first Kenpachi is still alive, so everyone else who has publicly held the title is technically a fraud.

Even if almost no-one has any idea that that's the case. :p

I mean, you can make the argument that whoever is known by the name is the Kenpachi, but that spoils the joke.
