No he's not. He's first and foremost a Counter Guardian that abandoned his former identity.
The fact that he used to be the Japanese Emiya Shirou doesn't mean anything.
He's a Counter Guardian though, which kinda loopholes on "the creators of the Grail didn't even consider the possibility that one would actually get summoned".
