No proof, like say, the family we'd be visiting on a regular basis? I wouldn't be so assured of nobody in SS finding out about that tidbit of our backstory.
Our mortal family that we're still attached to from our most recent life. It's the truth, doesn't sound like there are laws against it so long as we don't stay too long, and like @Bob's Beard said, we could say that we're the reincarnation of a Shiba, not the son of a still living one.

All three options seem to involve diving into politics in one way or another. This seems to give the strongest personal position, at least.
I prefer this for a variety of reasons, mostly because it interests me. I've rarely seen stories where Ichigo's Shiba heritage is brought out in full from the get go. More often than not it usually just seems to be a passing thing, like a, "Oh, and I guess he's a Shiba too". Which, I mean, is fine, but I'd just like to see this more direct route too.
Also, for the arguments that this would endanger the fam back home, I doubt it. All in all, I feel like the people who are really dangerous already know we're a Shiba, or they could figure it out very easily with or without us taking the name. It's not exactly like we've been subtle with anything else, and there are people far better in these information and espionage battles than we are.
This seems more like an issue for the masses, and even an existential issue, rather than one that might put our family at risk. I'll admit, it could, but I sincerely doubt that taking the name would do anything significantly worse than what we've already done and/or are going to keep doing.
It's not like we've made a great big secret about what we want to do, and it's not like we're doing anything illegal yet. Dad's another matter, but that's something else.
Besides, if we take the name, people are more likely to go, "Oh, I totally see that," than, "Oh my god, you're an abomination. We need to kill your deserter family."
Then again, the Soul Society has been known to be kind of an asshole stuff. Aizen's meddling or not.
Still, our cousin isn't an idiot. She wouldn't have offered this if she thought there was even a small chance of getting family killed for it. Not without a plan. And she knows this game way better than Ichigo does.
As for the existential stuff, I like the idea of owning up to dad's legacy and his whole family. And it doesn't mean he has to discard mom's, either. He's more so taking up the torch of the new family he's found in the Soul Society. Just because he's accepting one-half of his family that he just found doesn't mean he's throwing away the rest of it. That's the way I see it, anyway.
And it'll be fun to see how people react now that he has an actual family heritage to assign to his name. One with some not insignificant pedigree
I'd also imagine it might give us more options in the political and upper-class world if we aren't just some nobody out of town new kid with fancy tricks. Yeah, that won't be enough for a lot of people, but it'll probably be enough for the pretentious pricks who'd barely glance at us. Everyone else? They're who Ichigo likes to deal with anyway. This seems like it'd open more doors in the long term.
That's the way I see it, at least.

Hm. Expectations to join the evil ninja cult 2nd division, increased risk of our immediate family getting killed, or more stress as we evade various assholes' invitations.
Putting aside claims of whether Ichigo will die as a result of any of these options (seriously, why does every vote seem to revolve around this, even when it's not directly relevant? No, don't answer this, it's rhetorical) - I view accepting the Shiba name as accepting a closer attachment to Soul Society. Ichigo's not ready for that - maybe one day he'll find a balance between his family in the living world and his afterlife in Soul Society, but today is not that day.
... that is not what we voted for. At least not what I voted for. The way the update is written makes it appear to we are just telling people left and right without them even having to ask that specific question. "Do you have Shikai?" ... we are just telling them. I am... very displeased that my vote was ignored like that. Lets be honest, no one should have asked if we had shikai.
I had assumed that the beginning of the update was her asking us what we did on the weekend. Our response, rather than something like 'studying, read about laws/nobles etc', we answered that we spent the weekend unlocking Shikai. The fact that she is probably going to rant about it for a while and other people over-hear and then come by to ask us if its true. Our vote is saying to tell the truth rather than lie.
Not all that interested in taking up the Shiba name to begin with, and am still concerned about it leading to our famil getting involved. People say that those involved probably already know, but I don't see something that indicates that Yamamoto "THE LAW!" Genryusai would know for one.
We know reincarnation happens, and adoption into noble families happens. I imagine the excuse Kukaku will cook up will be something like
"He looks like a Shiba, and his Zanpakuto is like a Shiba's, so he's probably a Shiba that got reincarnated in the living world then died again. Might as well adopt him and make it official."
