Realistically, and yea what a word to use, with a Wizard of Gellert Grindelwalds level, the shouldn't be a DC on Legilimancy, the only ones likely to even notice legilimancy in Planetos are Bloodraven (High Level Druid), Melisandre (Extremist Leader for the Die-hard Fundies of the Fire Church) and Benerro ( Fire-Pope of Volantis).
Quite possibly also the masters of the Faceless Men
This type of Legilimancy is a tad more invasive than usual. A glimpse of memories, emotions or thoughts is something that even those most versed in magic(like Melisandre or even Bloodraven) would find hard to notice. This would go beyond that, as you'd be trying to figure out the structure of an entire language. Grindelwald's skilled enough that if he's lucky, he'd be able to escape notice even when doing that, hence the DC.
You guys will only get such DC rolls if the Legilimency in question is out of the norm(especially when you're trying to evade notice).
