Canonically a CD attacked another Charloss and he never got in trouble for doing so. Capturing the guy is totally a legit outcome for Ken and wouldn't result in legal trouble.
 
If we duel, or play along and try to negotiate before immediately blowing up, we'll have more time to get a read on the situation. Duel's not a trap, it's just disadvantageous. I'd prefer duel over capture, as it's too risky, but I'd take talking stuff out over both, at least as our first move.

Yep! Mjosgaard clobbered the shit out of Charloss in canon, and it was 100% accepted behavior.

I really feel like if we attack it creates huge political consequences in the long term that we can't deal with, and if we duel he'll either pull out something he prepared in advance, or he'll find a way to utilize his CP-0 agents and Kizaru against us. It puts the ball in his court. Capture is the one option that leaves him no wiggle room, and lets Ken totally set the pace (and basically neutralizes CP-0 because it's a dispute between two Dragons which only the other Dragons can possibly judge. If it's a duel, they're free to act on Paomli's behalf)

So for those of you still on the fence about capture, Maz pointed out a very good point in the discord. Paomli is sailing with a jolly roger as a fucking pirate. He's a pirate who attacked a CD vessel, who is being captained by a CD marine. It is totally in our right to capture the guy.
 
If Paomli's under arrest in the Dawn's Brig, on the word of a Celestial Dragon (Kennard), then only a majority vote of other CDs can get him released. And this guy is a major political operator. A wheeler, a dealer, a schemer. He's a thorn in the side of others who hold political power in Mariejois. They might just be happy to have him out of the way for a while...

I don't disagree with all that you said, but the above could also mean that others try to get him free with no consequences because either a) they need him for something, b) he has something to hold over their heads, or c) he'd be a valuable person to have owing them significant favours. Not to mention the possibility of people siding with him just out of sheer spite or pettiness.
 
If we duel, what's the chance of him either having a monster of a pirate slave stowed away on his ship for exactly this occasion or him asking Kizaru to be his champion?

Just caught back up after I forgot about this around the Kamoloth arc. It is really cool to see how Ken has grown.
