The metaphysics of what makes you a shinigami never made a lot of sense (because of course they didn't, none of the metaphysics of the world ever made sense, thanks a ton Kubo).If shinigami powers are inherited, then that would make ichigo legally a shinigami by birth. Ishin, his father and a former captain, could stop the execution merely by proving he is ichigos father.

In canon they're apparently both a thing that can be transferred instantaneously (Rukia and Ichigo), but also something you can be trained in (at the shinigami academy, where mortal souls get taught how to be soul reapers), which makes it seem like there is a specific training regimen that builds up "shinigami-ness" like some kind of static electricity that can then be sent to someone else as a discrete package labeled "being a soul reaper".
Which seems... pretty dumb, frankly.
