Ethics and legality of offensive mind control?

Nation W has through various means developed a weapon system which allows them to exert mind control over enemy soldiers, with a number of effects:
  • The weapon affects a wide area, anywhere between a single city to a whole planet with relatively high percentages of effect. Early versions are likely to be indiscriminate, but will eventually become more precise as the users refine the technology- allowing them to only target the military by the time it reaches full deployment.
  • Those affected can be controlled, accepting the commands of the controller's nation. Those controlled retain most of their awareness and practical skills (and so can be used to operate equipment) as well as exercise basic self-preservation and care standards, but higher reasoning is limited and they have to be commanded to act unless given orders.
  • Alternatively, those affected sent into uncontrollable, indiscriminate rages and attack all those nearby to the death. Their practical skills remain and their physical capabilities and durability are heightened to the degree possible with a complete lack of self-preservation instinct or responsiveness to pain.
Assume three possible scenarios:
  1. Nation W's new weapon is primarily biological in nature and uses an external stimulus to control.
  2. Nation W's new weapon uses new forms of attack, possibly electronic, electromagnetic or sound-based in nature.
  3. The actual vector of the weapon is largely unknown even by the users.
Is this legal? Is this ethical? Do the scenario parameters for the nature of the weapon affect the judgement at all?

Are there any grounds in which the use of this weapon could be considered acceptable by Nation W?
 
Said weapon gets Nation W nuked into a self-illuminating parking lot by every nuclear power on Earth. It is, after all, an enormous threat to every other country on the planet.

It depends on the situation I guess.
Have other nations or non-state deployed similar systems in the past without punishment?

Alternatively, do semi-practical countermeasures exist (e.g. Pop singers or autistic guitarists?)

Also, how nefarious are the opposition?
