They are a protected minority! But at places like standing rock protestors were, "blasted with high-pitched sound cannons and described being held in "what appeared to be" dog kennels, with identifying numbers written on their arms."

Moreover, groups are only protected classes when there's been a history of discrimination on the basis of that class.
